Terms of Service
These Terms of Service (“Terms”) govern your access to and use of SCORM Craft, a service that converts SCORM packages into a branded HTML and SCORM 1.2 course. Please read them carefully.
In short: you keep ownership of your course content, you are responsible for having the rights and notices needed to upload it, and we provide the conversion service on the terms below. This is a business tool, not an LMS.
1. Agreement to these Terms
These Terms form a binding agreement between you (or the organization you represent) and [Legal entity name], operator of SCORM Craft (“SCORM Craft”, “we”, “us” or “our”). By creating an account, uploading a package, paying for a course, downloading a rebuilt course or otherwise using the service, you agree to these Terms. If you do not agree, do not use the service.
If you use the service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization. You must be at least 18 years old and legally able to enter into contracts.
2. The service
SCORM Craft lets you upload a supported SCORM package, extract its content and assets, apply branding (name, logo, colors, author credit and player language), preview the result, and download a rebuilt HTML and SCORM 1.2 package. The service is a content conversion and packaging tool. We do not host your course for learners, provide an LMS, deliver training, or guarantee that a course is suitable for a particular audience, jurisdiction or regulatory purpose.
Features may be added, changed or withdrawn. Beta or preview features are provided “as is” and may be unstable. We may impose reasonable limits on file size, storage, processing time or usage to protect the service.
3. Accounts, access and security
We use email magic links instead of passwords. You must provide an email address you control, keep access to that inbox secure, and promptly tell us if you believe your account or a link has been compromised. You are responsible for activity under your account. Guest uploads are associated with a signed browser cookie and can be claimed when you sign in; if you lose that browser or clear cookies before claiming a course, you may lose access to the guest upload.
4. Customer content and licence
You retain all rights, title and interest in the SCORM packages, text, images, video, audio, quizzes, branding assets and other materials you upload (“Customer Content”). You grant us a limited, worldwide, non-exclusive licence to host, copy, extract, transform, transmit, display and rebuild Customer Content solely to provide the service to you, to maintain and secure the service, and to comply with law. This licence ends when the relevant Customer Content is deleted, except for residual copies in backups or legal records retained as described in our Privacy Policy.
You are responsible for Customer Content. You represent and warrant that you have all rights, licences, consents, notices and legal bases needed to upload it and to have it processed, including for any personal data of learners, employees or other individuals contained in the package. You must not upload content that infringes intellectual property, violates privacy or publicity rights, contains malware, or is unlawful. If your course contains personal data, you are the controller and we act as your processor as described in our Data Processing Addendum.
4A. Third-party authoring tools, licences and notices
You represent and warrant that you own or have a valid licence to the SCORM package and all Customer Content, including the right to reproduce, modify, create derivative works from, rebrand and process it through the service. You must not upload a trial, evaluation, unlicensed or infringing package unless your licence expressly permits those acts.
You are responsible for complying with the terms of any authoring tool, LMS or third-party service used to create the package. The service is not intended to circumvent licence restrictions, technological protection measures, seat limits, expiry dates or other access controls. You must not use the service to remove or alter copyright notices, watermarks, attribution or other copyright management information from third-party content unless you have the right to do so and applicable law permits it.
The rebuilt course is a new player implementation built from your content. It does not include the authoring tool’s runtime. The original reference view retains the source package’s notices. SCORM Craft is an independent service and is not affiliated with, endorsed by, sponsored by or certified by any authoring-tool provider. All third-party trademarks and copyrights belong to their owners; any reference to a format or tool is for identification only.
5. Acceptable use
Your use of the service must comply with our Acceptable Use Policy, which is part of these Terms. We may suspend or remove content or access that we reasonably believe violates these Terms, the Acceptable Use Policy or applicable law.
6. Payments, taxes and billing
Prices are shown in the service before checkout. Unless stated otherwise, the service is sold as a one-time payment per course, not a subscription. Payments are processed by Dodo Payments. You authorize us and Dodo Payments to charge the payment method you provide for the amount shown, including applicable taxes. You are responsible for any taxes, duties or levies associated with your purchase, except taxes on our income.
If a payment fails, is reversed, or is subject to a chargeback, we may suspend access to the paid download until the matter is resolved. We may change prices for future purchases; changes do not affect a purchase already completed. Demo or test mode may simulate a payment without charging a real card; demo downloads are for evaluation only.
7. Refunds
Refunds and cancellation are governed by our Refunds & Cancellation Policy. Nothing in these Terms limits mandatory consumer rights that cannot be waived under the law applicable to you.
8. Intellectual property
We and our licensors own the SCORM Craft service, software, player, templates, design system, documentation, trade names and logos, excluding Customer Content and customer branding. You may not copy, modify, reverse engineer, resell or create derivative works of the service except as expressly permitted by law or by us in writing. If you send feedback, you grant us a perpetual, worldwide, royalty-free licence to use it to improve the service, without identifying you.
You retain ownership of your own brand assets. You grant us permission to display your brand inside the rebuilt course and in previews shown to you. We do not acquire ownership of your trademarks.
9. Confidentiality
Each party may receive information that the other treats as confidential. The receiving party will use it only to perform the agreement, protect it with reasonable care, and disclose it only to personnel and advisers who need it and are bound by confidentiality obligations, or as required by law. This does not apply to information that is public, independently developed, or lawfully received from a third party.
10. Availability, support and changes
We aim to keep the service available and secure, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, deploy updates, or temporarily suspend the service for security or operational reasons. Support is available at support@scormcraft.app. Any service-level commitment must be agreed in a separate written agreement; nothing in these Terms creates an SLA.
11. Disclaimers
To the maximum extent permitted by law, the service is provided “as is” and “as available”. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy and quiet enjoyment. We do not warrant that a rebuilt course will be compatible with every LMS, browser, device or SCORM player, that it will preserve every interaction or visual detail, or that Customer Content is accurate, lawful, accessible or compliant with any regulation. You are responsible for testing the downloaded package before using it with learners.
12. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill or business opportunities, even if advised of the possibility. Our aggregate liability arising out of or relating to the service or these Terms will not exceed the greater of (a) the amounts you paid us for the affected course in the twelve months before the event giving rise to the claim, or (b) USD 100.
These limitations do not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that cannot be limited by applicable law. Nothing in these Terms excludes mandatory rights of consumers.
13. Indemnification
You will defend, indemnify and hold harmless SCORM Craft and its personnel from claims, damages, liabilities, costs and reasonable legal fees arising from Customer Content, your branding, your use of the service in violation of these Terms or law, or your failure to obtain the rights, consents or notices required for personal data in a course, including any claim by an authoring-tool provider that Customer Content, your instructions, or your lack of rights to modify, rebrand or remove a watermark or runtime infringes its rights or breaches its licence. We will defend you against third-party claims that the SCORM Craft service itself infringes intellectual property, subject to prompt notice and control of the defence, and will pay damages finally awarded or agreed in settlement. This indemnity does not apply to claims caused by Customer Content, modifications, or use in combination with non-SCORM Craft materials.
14. Term, suspension and termination
These Terms apply while you use the service. You may stop using it at any time and may request deletion of your account and courses. We may suspend or terminate access if you materially breach these Terms, fail to pay, create a security or legal risk, or if required by law. Where reasonable, we will give notice and an opportunity to cure. On termination, your right to use the service ends; provisions that by their nature should survive (including ownership, disclaimers, liability, indemnity and governing law) survive. Deletion of data is described in the Privacy Policy and DPA.
15. Governing law and disputes
These Terms are governed by the laws of Chile, without regard to conflict-of-law rules. Subject to mandatory consumer protections, the courts of Santiago, Chile have exclusive jurisdiction. Consumers in the European Union, the United Kingdom, Chile or another jurisdiction with mandatory local rights may bring proceedings in their local courts where the law gives them that right. Before filing a claim, please contact us at legal@scormcraft.app so we can try to resolve the matter informally.
16. Changes to these Terms
We may update these Terms to reflect changes in the service, law or our practices. If a change is material, we will provide reasonable notice (for example, by email or a notice in the service) before it takes effect. Changes do not apply retroactively to disputes already arising. Continued use after the effective date means you accept the updated Terms.
